Arbitration Services
Arthur J. Murphy has served as an arbitrator for the Cook County Mandatory Arbitration Program since its establishment in 1990. In the private sector, he has also served as an arbitrator in numerous three-member arbitration panels involving uninsured and underinsured motorist claims. In this capacity, he has been appointed as both claimant, respondent and neutral arbitrator. He is also an arbitrator for the American Arbitration Association.
Mediation Services
Mediation is a mechanism for the settlement of a dispute which presents an alternative to a trial or an arbitration. The differences between all alternatives are stark.
In a trial, of course, either a Judge or Jury renders a decision. In the arbitration process, a single arbitrator or a panel of arbitrators decides the case.
Mediation, however, is unique in that the disputing parties themselves decide the case, with the help of a skilled mediator. One might refer to a mediator as a “facilitator” – an independent third party who will listen to the issues described by the parties, and help direct them to a mutually agreeable resolution.
Advantages to the mediation process are many, but some of the more important ones are:
- The cost of the mediation itself will be far less than the cost of preparing a case for trial or arbitration.
- The time element is crucial. Mediation is much quicker than waiting for the trial (and possible appeal) of a legal dispute. The parties eliminate the fear, anxiety, and risk of going through the legal system, and will
be able quickly to put the dispute behind them with a satisfactory solution that they themselves have created.
- Mediation is completely voluntary. The mediator does not make any rulings or decisions and no one can force the parties to accept a particular resolution. The parties are free to craft a settlement agreement which will work best for them.
- Again, a resolution is only reached if both parties agree that it will work.
